Politics or law?


This working paper focuses on the relationship between law and politics in the European Union. The membership in the European Union has created new legal possibilities for actors striving for political change in the Member States.

It is possible to talk about a juridification of politics or a politicisation of law. Private actors can now challenge national legislation which constitutes the very foundation of a certain national policy before national and European courts. Accordingly, issues which were in the past decided by politically shaped institution can now be decided through legal processes. When a question is pending before the European Court of Justice, governments have a possibility to put forward their arguments and hence to influence the Court
