New Criminal Law Developments in the Community Legal Order(2007:1u)
This report is part of a broader analysis of the constitutional implications of the development of criminal law in Community law. It provides a systematic overview over the development of criminal law within the European Union.
In a growing number of situations, Community law has exercised an indirect influence on national criminal laws. In case C-176/03, Commission v. Council, the Court went a step further and declared that the Community has to some extent competence of its own in criminal matters.
