The Legal Basis Game and European Governance (2006:12)
This report analyzes current tendencies in decision-making and the evolving concept of “legislation” in the EU. The causes and consequences of the “legal basis game” are discussed.
Three broad conclusions emerge. First, all of those engaged in and with EU institutions should equip themselves to understand the “legal basis game”. Second, the decision making procedure in the draft constitution should be considerably simplified. Third, simpler and more streamlined institutions may facilitate greater transparency and eventually greater legitimacy in European governance.
